Although there’s plethora of cases on how an employer should proceed whenengaging on a retrenchment exercise, still there are insurmountable case references, where employers have failed to follow the law. This is by no means a commentary toadmonish employers about their shortcomings, but rather to increase awareness of the negative effects that sometimes occur when workers’ services are retrenched improperly.
Sometimes employers are not cognizant of the long term negative effects their actions may bring on them and by extension their organization.
When an employer do not incorporate the legislation of the Retrenchment Severance Benefit Act (RSBA),and seek guidance from the International Labour Conventions during their retrenchment exercises, the results leaves lasting damaging effects even years after the retrenchment exercise was enforced, towards all parties involved.
A restructuring exercise in any organization can be an emotional rollercoaster for both employers and employees.However, if the employer is amenable to being accountable and acts on principle, transparency, morality and fairness, retrenchment of a worker/s does not have to become upheaval in their organization, community and the country.
