Drafting an employee contract may seem like a no brainer to many employers. After all if the business is theirs, then they should have the right to design a contract to suit them and the business, right?
The answer may come as a surprise to many, when what they thought is quite the opposite. Many employers often find themselves in long winded and costly litigations at the Industrial Court simply because of the contracts they’ve designed. Unfortunately, many employers may lack comprehension of how an employee’s contract is supposed to be, and some design contracts that are simply not suited for the business for which they operate.
The pitfalls of learning by the employer within their contracts are evident in the policies outlined; sometimes totally exclude consultation of the statutory guidelines of Trinidad and Tobago.
Examination of several employee contracts will highlight the factors which cause problems for both employer and the employee in the long run. But with proper consultation and restructuring of contracts within legislation and tailored to the specific needs of the organization, will help eliminate the overwhelming blunders employers make.
