Module 1 provides an overview of the statutes with a special focus on the sovereign rights of Tribal Nations under Pub. L. 93-638; and the Congressional intent under the Indian Self-Determination Act. What are the differences between Pub. L. 93-638 contracts and commercial contracts? What programs may be contracted under Pub. Law 93-638? What are inherent Federal functions? What are the funding provisions and funding protections? What are contract support costs (indirect costs, direct contract support costs, start-up funds, pre-award costs)? What are tribal rights to appeals and contract disputes? This module will identify how contracts under Pub. L. 93-638 are different from regular federal contracts and commercial contracts.
