Disciplinary Dismissal and the Grievance procedures at some organizations appear to be undergoing try outs and how an employer feels an employee/worker should be disciplined, rather than what is the correct thing to do. Knowing what steps should be taken by the employers, should they be faced with an issue in which the employee needs to be disciplined, can be overwhelming.
The employers, in their efforts to quell the issue may not have the knowledge, time or patience on learning how to go about initiating a disciplinary or grievance procedure, and may opted to discipline the employee which they deem fit. In the end it may cost the employer way more than what they bargain for, if the employee within their rights believe that the action taken against them by their employer was unjust, harsh and oppressive.
When an employee breaches the rules and regulations of an organization, (with the exception of an act which make cause the employer to summarily dismiss their services), an employer must be able to show the court that the action they took against the employee were within the laws of Good Industrial Relations Principles and Practices, and that there were no breaches in the rules of natural justice.
Sometimes an employer might be desperate to terminate the services of a troublesome employee, and uses their authority to do so, only to have to pay money to that same employee at court, because of their failure or refusal to adhere to such rules.
The Industrial Court pays much attention to jurisprudence even in the smallest employment matter, and an employer should take into account that their name and their business is forever recorded at Court, especially if the case did not go in their favour.
It may do an employer well to become knowledgeable about the varying areas of discipline and grievance procedures, and how they should be applied. Seeking sound advice and having fervent discussions on these issues, is a step towards elevating the employer and employee relationship, and promoting a healthier working environment.
